Terms of Service

1. For all custom cake orders an invoice for the full amount of your cake order will be sent via email. To secure your preferred date this invoice must be paid in full.  Please do not fill out form if you are not ready to submit full payment. All payments will be through emailed invoice link. NO CASH OR OTHER ELECTRONIC PAYMENTS ACCEPTED

2. If you need to postpone/move your date due to COVID-19 or any other reason, we need to know a minimum of one week before the event date. Within one week of your event date, we will have had supplies and ingredients ordered and there simply won’t be enough time for us to recoup any of those expenses. If you need to cancel or postpone your event within one week of the event date, we will not be able to transfer any amount paid toward the order, and the new date will require a completely new and separate order. If you need to postpone the order, the new date will need to be within 2 months of the original scheduled event date.

3.  You are responsible for providing an appropriate environment for the cake/ treat(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 22 degrees or below.

4. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

5. If you or your representative elect to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession.

6. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.

7. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.

8. We  reserve the right to refuse service to anyone exhibiting rudeness or any inappropriate behavior at any point.

9. ALL ORDERS ARE FOR PICK UP ONLY! We are located in the New York Bronx area. You acknowledge that you or a trusted representative are responsible for picking up your order. ANY order placed with a shipping option will be CANCELED and refunded with a deduction of the refund fee.

10. Performance of this agreement is contingent upon the ability of Cakes By Ian to complete the agreement and is subject to labor disputes or strikes, accidents, and other causes beyond our control
